Users who purchase from Mocreal srl through the website www.quelledue.it declare that they know and accept these general terms and conditions.

These terms and conditions may be subject to changes and their date of publication on the website is equivalent to the date of their entry into force. These terms and conditions purchases made on the website www.quelledue.it in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree No. 206/2005, amended by Legislative Decree No. 21/2014 and by Legislative Decree No. 70/2003 on electronic commerce.

The purchase is allowed only to Users who qualify as "Consumers" or any natural person who is at least 18 years old and who acts, by entering into a contract, for purposes unrelated to their own commercial, craft or professional business.

The Owner reserves the right not to accept purchase order proposals from parties other than the "Consumer" or order proposals for which there is a suspicion of fraudulent or illegal activity. In such cases, the Owner will notify the User of the non-acceptance of the order proposal. All order proposals sent by the User must correspond to normal consumption needs.

Mocreal srl is the manufacturer and seller ("Data Controller") of the QL2 brand garments, owner of the use of the e-commerce website www.quelledue.it for the online sale of clothing and accessories.

Purchase and registration procedure

In order to purchase, Users can register or complete the purchase through the Guest mode. To complete the order, they must provide, in a truthful and complete manner, all the data requested in the checkout phases and fully accept the privacy policy and these general terms and conditions. The Owner does not have visibility on the access credentials of its Users, who therefore have the duty to keep them.

All orders sent are an offer to purchase the products published on the website. Orders are subject to the availability and acceptance of the Owner, who reserves the right not to confirm an order, in particular due to the possible unavailability of one or more purchased products. The order is regularly sent by the User if the checkout procedure is completed and is subject to payment of the price, taxes and shipping costs (where applicable).

The 'Order Receipt Confirmation' is not an acceptance of the order. The conclusion of the contract takes place when the Owner sends the 'Preparation in Progress' email to the email address provided by the User during the purchase or, alternatively, takes care of the execution of the order by sending the shipment tracking number. The Owner reserves the right not to confirm an order by communicating the User, through the email address associated with his/her purchase, any unavailability of one or more of the products purchased. In this case, the Owner will refund the price and shipping costs incurred by the User on the same payment method with which the purchase was made, no later than 7 working days.

Availability of Products and Images

The actual availability of a product is indicative, as several Users can purchase it at the same time and make a product unavailable that another user had already placed in the cart. The photos included are for illustrative purposes as the products, given their nature of artisanal production, may differ slightly in appearance and color.

Prices

All prices shown on the website include VAT. Prices are subject to change without notice. However, the Price conditions for orders already sent by the User are acknowledged and confirmed at the price and shipping terms and conditions (if any) in force at the time of sending. No price increase can be asserted by the Data Controller on orders acquired prior to the price increase, even if not delivered for reasons other than order cancellation.

Delivery times and shipping costs

Deliveries are normally made within 24/48 hours and in any case no later than 72 hours in Italy, unless otherwise specified in the order confirmation. In some critical periods for couriers, such as Christmas and other holidays, delays in delivery can occur. Delivery is entrusted to leading national couriers. It takes place with an attempted delivery that is followed, in the event of an absent recipient, by the non-delivery report left by the courier. A second delivery attempt is made, on the next working day. If this delivery is also unsuccessful, the User must contact the courier who made the delivery to set the date of the new delivery no later than 5 working days after the first delivery attempt.

The Owner is not responsible for any delays occurring in the shipment due to agreements made between the User and the courier, due to the absence of the recipient and incorrect address and/or recipient data.

Shipping costs are free for shipments within the European territory, unless otherwise indicated in the cart once you have entered the delivery data.

The Owner is not responsible for any damage suffered by the User due to delivery delays. Upon delivery, the User must check the content before accepting it, thus specifying any anomalies in the courier's delivery form. The Owner cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the completion of the purchase order by the User.

Responsibility

Mocreal srl takes on no responsibility for disservices attributable to force majeure, if it fails to execute the order within the time specified in the contract, including governmental orders and national or regional health emergencies that may slow down or prevent order fulfillment. Mocreal srl cannot be held liable to the User for disservices or malfunctions connected to the use of the Internet outside of its own control or that of its sub-suppliers. Mocreal srl will also not be liable for damages, losses and costs incurred by the User as a result of the failure to execute the contract, as the User is only entitled to a refund of the price paid. Mocreal srl takes on no responsibility for any fraudulent or illegal use, which may be made by third parties, of credit cards used to pay for the products purchased, if it proves that it has adopted all the ordinary possible precautions and based on ordinary diligence.

Payment methods

Through the website www.quelledue.it, Mocreal srl accepts only the advance payment of the ordered products. Mocreal srl uses third-party tools for processing payments and does not in any way come into contact with payment data - such as those relating to the credit card - provided. The accepted payment methods are PayPal and all major credit cards (by way of example and not limited to Visa, MasterCard, American Express). 

In the case of payment by credit card through the PayPal or Stripe circuit, the credit card data are processed directly by the bank to which www.quelledue.it has entrusted the management of payments. In case of payment with PayPal or by credit card (on the PayPal or Stripe circuit), the actual charge will take place at the time of the conclusion of the check-out procedure. The information is encrypted using the latest generation of encryption systems that prevent its use by third parties and is sent directly to the bank. Mocreal srl reserves the right to make a request to the bank issuing the card to verify the authenticity of the ownership of the card itself or to request an identity document from the User to verify the ownership of the card. 

Legal guarantee of conformity

Pursuant to and for the purposes of the European Directive 44/99/EC and the Italian Legislative Decree No. 206/2005 (Consumer Code), the Owner guarantees that the Products are free from design and material defects and comply with the descriptions published on the website for a period of 2 (two) years from the date of delivery of the Products to the Consumer. The application of any warranty is excluded in case of use or washing of the Product that does not comply with that of the Product and the instructions/warnings provided by the Owner, or shown on the tags or labels.

Pursuant to Art. 130, paragraph 2, of the Consumer Code, the Consumer has the duty to report defects and non-conformities within and no later than 2 (two) months from discovery, by sending the Customer Service of the Owner, orders@quelledue.com:

  • return form received together with the order completed in its entirety, with the exception of the "Return Code" field that will be sent by the Owner to the email address from which the return request form is sent.
  • detailed description of the defect and/or non-conformity found
  • supporting documentation: photograph(s) of the Garment

Following receipt of the return request for non-compliance with the form and documentation, the Owner evaluates and carries out quality checks to verify the actual non-compliance of the Product. The Owner decides whether to authorize the return of the Products by providing the User by email with a "Return Code", to be transcribed in the appropriate space of the return form and to be included in the package together with the items the User wants to return. 

The authorization to return the Products does not constitute recognition of defects or non-conformities, the existence of which must be ascertained after the return. The Products for which the Owner has authorized the return must be returned by the User, together with the return form containing the "Return Code", within fourteen (14) days of receipt.

In case of non-recognition, the Owner returns the Products received, to the address used for the delivery of the order during the purchase phase.

Right of withdrawal

The User has the right to exercise the right of withdrawal in accordance with Art. 52 of Legislative Decree No. 206 of 6 September 2005 (the "Consumer Code"), without giving any reasons, within 14 days from the day on which the User received the products purchased on www.quelledue.it

In accordance with Art. 54 of the Consumer Code, the right of withdrawal can be exercised by following one of the methods listed below:

a) Procedure available online

  • in case of purchase as a Registered user, the User can exercise the right to withdraw and return the items under 'Product Return' available online in the History and Order Details section of the customer area;
  • in case of purchase as a Guest user, without registration, the User can access the Guest tracking from the order receipt confirmation email sent at the time of purchase. The User can create a registered account and follow the 'Product Return' procedure indicated above;

b) Return form 

  • Transmission of the return form present inside the package, to the address orders@quelledue.it, completed in its entirety following the instructions in the form itself;

The return form must be completed in all fields, with the exception of the "Return Code" field that will be sent by the Owner to the email address from which the return request form is sent. Once the "Return Code" has been received, this will be transcribed in the appropriate space. The form complete with "Return Code" must be included in the package together with the items to be returned.

The products must be returned in their original packaging as per the instructions included in the packaging delivered by us and delivered to the shipper within fourteen (14) days from the exercise of the withdrawal. 

The right of withdrawal is exercised correctly when the following conditions are met:

  • the garments must not have been used, worn, washed and must not show signs of use or damage;
  • the garments must not be damaged in any part whether it is visible or positioned inside the garment itself;
  • the tag and labels and accessories must be attached to the products and must not have been removed even partially;
  • the right of withdrawal is exercised within fourteen (14) days of receipt of the products by following one of the methods indicated in these Conditions and Terms.

Refund times and methods

Following receipt of the return and verifying that all the requirements have been met, Mocreal srl sends an email confirming acceptance of the return and proceeds with a full refund of the price paid. The reimbursement is activated within fourteen (14) days from the date on which the Owner has received documentation of the exercise of the right of withdrawal. The actual time for crediting or returning the sums paid by the User depends on the payment methods used and consequently:

  • if the purchase was made by credit card, the repayment time depends on the card management company;
  • if the purchase was made via PayPal, the refund is made directly to the PayPal account used for the purchase and is immediately visible. 

Electronic invoice

By placing an order on the website www.quelledue.it and filling in the fields for the issuance of the invoice, this will be provided only in electronic format and only on condition that all the fields necessary for its issuance are filled in (VAT, SDI Code). The invoice must be printed and kept as original, as required by the Circular of the Revenue Agency No. 18/E of 24/06/2014.

Photographs, texts, descriptions, images and all that on the website are granted for use by Mocreal srl. The full or partial reproduction of any part of the site, including photographs and texts, is therefore prohibited without the prior written authorization of Mocreal srl.

Account cancellation and termination of User accounts

Registered Users can deactivate their accounts or request their cancellation at any time, through the website www.quelledue.it or by contacting the Owner directly. The Owner, in case of violation of these Terms and Conditions, reserves the right to suspend or close the User's account at any time and without notice.

Changes to these Terms and Conditions

The Owner reserves the right to make changes to these Terms and Conditions at any time, thus giving notice to the User by posting it on the website www.quelledue.it. The changes to these Terms and Conditions replace and repeal the previous ones, therefore, the User who used the service prior to the changes accepts the new terms without reservation.

Applicable law and jurisdiction

These Terms and Conditions and all disputes regarding the execution, interpretation and validity of this Contract are subject to the law and jurisdiction of the Italian State. The jurisdiction will be the one freely chosen by the consumer.
